Terms and Conditions
1. This is a legal agreement between Purespace and all clients of Purespace. These terms and conditions of business apply to all work undertaken by Purespace, unless otherwise specifically agreed in writing. By using an online order form or by ordering via telephone, fax, post or email you agree to be bound by these Terms and Conditions. All orders and requests for work or any additional services will be subject to Purespace’s acceptance which will be notified to you when Purespace confirms your order and will be governed by these Terms and Conditions. Purespace reserves the right to amend this agreement from time to time and new versions of this agreement will be posted on Purespace’s web site.
2. Purespace provides services that include but are not limited to photographing and filming, drawing floor plans and creating virtual tours in residential and commercial property. Purespace reserves the right to reject any commission.
3. Purespace reserves the right to change its prices at any time. Payments are due on receipt of any invoice from Purespace and Purespace reserves the right to charge interest on any invoices more that 30 days overdue. Purespace reserves the right to charge for the cost of debt recovery for invoices more than 90 days overdue.
4. Purespace will use reasonable skill and care in shooting and processing images and virtual tours to fulfill a client’s order. It is your responsibility to check images and virtual tours supplied to ensure that they are correct in all requirements.
5. Purespace uses reasonable care and attention when drawing and measuring floor plans. All floor plans supplied by Purespace are intended for indicative purposes only, they are not intended to be scale drawings and measurements and areas quoted are approximate, whether or not a suitable disclaimer appears on the drawing. Purespace accepts no liability whatsoever for any error or omission or inadvertent incorrect statement in a floor plan.
6. Where Purespace agrees as part of an order to host files on the Purespace web server, then in the absence of a specific agreement to the contrary, such hosting will be provided for a period of 12 months. At the expiry of this 12 month period Purespace reserves the right to remove the files without notice or charge the client to leave the files in place for an agreed amount of time beyond the first 12 months.
7. Purespace accepts no responsibility for any issue of colour or clarity arising from the viewing or printing of any Purespace image, virtual tour or floor plan on any computer monitor, television or printer. Purespace accepts no responsibility for the calibration of clients, or client’s customer’s computer monitors or printers and clients should be aware that images often look different in print than on the screen of a computer.
8. Purespace client will be liable for the full cost of an order if Purespace’s employees or agents are unable to gain access to the premises for an agreed appointment. If another appointment is made to re-visit the premises, this will be at an additional cost to be agreed between the parties. Purespace’s client will be responsible for ensuring that the premises to be photographed or drawn for a floor plan are in a suitably presentable condition. Purespace’s client will be responsible for ensuring that the display and distribution of photographs, virtual tours, floor plans and printed particulars, via internet, post, hand delivery, fax or email complies with all relevant legislation.
9. Purespace will not be liable to you or to any third party for any loss of profits, loss of sales, loss of turnover or loss of use or corruption of data or software or for any indirect, consequential or special loss. This does not exclude Purespace’s liability in respect of fraud or in respect of death or personal injury caused by Purespace’s negligence. Purespace does not guarantee that any of its virtual tour files shall be playable on any particular computer system. Purespace will not be responsible for any delay or failure to carry out Purespace’s commissions under this agreement for reasons beyond Purespace’s reasonable control including but not limited to the acts or omissions of a third party or your failure to perform your obligations.
10. Purespace reserves the right to terminate this agreement without notice for any reason including non-payment of fees. Purespace’s fees shall be payable immediately on termination or expiry howsoever caused of this agreement.
11. All copyright and other intellectual property rights in and relating to the commission shall be owned exclusively by Purespace.
12. This agreement will be governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales. If any provision of this agreement is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the agreement which will continue in full force and effect.
13. All rights not expressly granted herein are reserved.
14. Our policy is that a client can postpone a job at any time up to 5.30pm the day before the visit to the property without cost, so long as Purespace has not already become committed to expenditure which can not be avoided (e.g. travel costs). If Purespace has already become committed to such costs, Purespace will charge the client accordingly. Cancellation or postponement of a job for any reason after 5.30pm of the day prior to photography incurs an automatic charge equivalent to 25% of the full price of the job.
15. Purespace hours of business are 8.30am to 5.30pm Monday to Friday.
16. Purespace reserves the right to decline any order.
Statement of Privacy
All of the data and information collected on this site is for the sole use of Purespace.
We can state that no personal information submitted to this site is supplied to any third party, or used for any purpose other than that for which we collect it.
The names, addresses and contact details of our clients are treated in the strictest confidence.
